Your use of this website is your express written consent to these Terms of Service (“Terms”.)

1. Agreement to Terms

By accessing, browsing, or using the Naven Federal Credit Union ("Credit Union," "we," "us," or "our") website and any associated digital services, such as mobile applications, and any online services available through our sites (collectively, our ”Sites”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”), along with our Privacy Policy and all applicable federal and state laws. If you do not agree to these Terms, you must immediately cease all use of our Sites. If there is any conflict between these Terms and the Policy Policy,thePrivacy Policy will prevail. 

2. Eligibility

Our services are intended for individuals who are at least 18 years of age. We do not knowingly solicit or collect personal information from children under the age of 13, in compliance with the Children's Online Privacy Protection Act (COPPA). Use of specific secure banking features may require established membership and successful multi-factor authentication.

3. Intellectual Property Rights

All content on this website—including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software—is the exclusive property of Naven Federal Credit Union or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.   • Credentials: You must never share or reveal your individual passwords to anyone else to prevent unauthorized access.
  • Encryption: Non-public Personal information (as defined in the Privacy Policy) should not be sent via unencrypted electronic communications.

7. Dispute Resolution; Arbitration; Class Waiver, and Jury Waiver

  • Arbitration Agreement:  By using our digital services, you agree that any and all disputes between you and us shall be resolved through binding arbitration. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE ALSO WAIVING YOUR RIGHT TO A TRIAL BY JURY AND YOUR RIGHT TO PARTICIPATE AS A MEMBER OF A CLASS ACTION LAWSUIT. This Arbitration Agreement is governed by the Federal Arbitration Act (FAA).
  • Informal Resolution:  Before initiating formal arbitration, you and the Credit Union agree to make a mandatory good faith effort to resolve the dispute informally. You must provide a verified notice of the dispute (the “Notice”) containing at least the following information:
    • name, 
    • last 4 digits of your social security number and account in question, and
    • reasonable statement of facts as to the issue  

The parties will have a sixty (60) day period from the date of our receipt of notice to attempt to reach a

. resolution.

  • Small Claims Exception:  Notwithstanding this agreement to arbitrate, either party may bring an individual action in small-claims court for disputes within the scope of that court's jurisdiction.
  • Opt-Out Instructions:  You may opt-out of this Arbitration Agreement by sending a signed, written notice to us at member-support@navencreditunion.com within thirty (30) calendar days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt-out.

8. Mobile Application Terms

App Compliance

  • You acknowledge that these Terms are concluded solely between you and Naven Federal Credit Union. Apple, Inc. and Google, Inc. are not parties to these Terms and have no responsibility for the application or its content.

License

  • The Credit Union grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use our mobile application solely for your personal, non-commercial use on devices you own or control.

Liability and Support

  • Naven Federal Credit Union is solely responsible for providing any maintenance and support services for the application. Furthermore, the Credit Union—not the app store providers—is responsible for the investigation, defense, and settlement of any third-party intellectual property infringement claims related to the application.

9. Third-Party Services and Content

The Credit Union may utilize third-party providers or incorporate their content to deliver our digital services. You acknowledge that any reliance upon warranties or representations offered by entities other than the Credit Union is strictly at your own risk. Furthermore, your engagement with third-party platforms or services may be subject to additional terms of use and privacy protocols established by those respective operators.

Naven Federal Credit Union employs strategic partners to aggregate your liability and billing data from external financial institutions. By utilizing any of our services or sites, you grant these partners the express authority and power to act on your behalf to access and transmit your personal, credit, and financial information from relevant institutions and credit bureaus to the Credit Union, in accordance with applicable law and solely for the provision of services.

10. Limitation of Liability

IN NO EVENT SHALL NAVEN FEDERAL CREDIT UNION, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS WEBSITE. ALL CONTENT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
